Liebe Freund:innen der H48,
Es ist so Soweit! Die erste WG der H48 hat eine Kündigung und inzwischen auch eine Räumungsklage erhalten. Jetzt brauchen wir deine Hilfe: für den Erhalt der H48 als unser Zuhause, als sozialer Begegnungsort für unseren Schillerkiez, und nicht zuletzt als Struktur politischer Organisation und als stadtpolitischer Akteur! Bitte verbreitet diesen Aufruf weiter.
Mit dem Urteil des Bundesverwaltungsgerichts vom 9.11.21, das die Ausübung des Vorkaufsrechts in Milieuschutzgebieten praktisch verunmöglicht, hat sich auch unser Traum von Selbstverwaltung zerschlagen. Unsere Häuser sind an eine profitorientierte Investor:in gegangen, der unser zu Hause herzlich egal ist. Bislang hat die Verdrängung v.a. alteingesessenes Gewerbe betroffen. Bald soll es den Wohngemeinschaften im Fabrikgebäude an den Kragen gehen, die bereits auf Immobilienportalen angeboten wurden. Den WG-Bewohner:innen wurden auf dem Papier jahrzehntelang ihre Wohnrechte systematisch vorenthalten. Die Eigentümerin geht davon aus, dass es sich um Gewerbemietverträge mit teilweiser Wohnnutzung handelt, die jederzeit binnen einer überschaubaren Frist kündbar sind.
Die erste WG hat eine Kündigung erhalten, die die Eigentümerin mittels Räumungsklage durchsetzen möchte! Das wird nur der Anfang sein. Wir werden Klagen führen müssen, um Wohnmietrecht für unsere 8 WGs zu erstreiten und die erwartbaren Kündigungen abzuwenden für unsere WGs und den Projektraum. Diese Klagen sind mit finanziellen Risiken verbunden, die wir auf möglichst viele solidarische Schultern verteilen müssen. Wir bitten Euch in Euren Geldbeutel zu schauen, ob ihr einen Beitrag leisten könnt – damit die H48 als unser zu Hause, als sozialer Begegnungsort für unseren Schillerkiez, als Ort subkultureller Gestaltung und alternativer Lebensentwürfe und nicht zuletzt als Struktur politischer Organisation und als stadtpolitischer Akteur erhalten bleiben kann. Deine Unterstützungsoptionen
1. Die kleine aber feine Spende (<200€)
Du spendest uns einen Geldbetrag Deiner Wahl bis zu 200€, den Du auf das Konto unseres Hausvereins (s.o.) mit dem Verwendungszweck „Spende“ überweist. Hier zählt jeder Euro! Werden Geldmittel gebraucht, ist das der Topf, der als erstes verbraucht wird. Wird Dein Geld nicht gebraucht, spenden wir es weiter an das Mietshäusersyndikat. Es können keine Spendenquittungen ausgestellt werden.
2. Die großzügige Spende unter Vorbehalt (>200€)
Ab einem Betrag von 200€ fällt Deine Spende, die Du mit dem Verwendungszweck „Spende“ auf das Konto unseres Hausvereins (s.o.) überweist, automatisch unter diese Kategorie. Reichen die kleinen aber feinen Spenden (1) nicht aus, wird dieser Topf angezapft. Wird Dein Geld bis zum Ende aller Gerichtsprozesse nicht gebraucht, überweisen wir es Euch zurück. Wird nur ein Teil dieses Topfes verbraucht, wirst Du Dein Geld anteilig zurückerstattet bekommen (Beispiel: wenn 40% des Topfes aufgebraucht sind, erhältst Du 60% Deiner Spende zurück). Es können keine Spendenquittungen ausgestellt werden.
3. Das letzte Sicherungsnetz (>1000€)
Mit 1000€ oder mehr kannst Du auch für uns bürgen. Du sicherst uns vertraglich einen Betrag Deiner Wahl zu, den wir Dich zügig nur in dem Fall bitten zu überweisen, dass die Kosten infolge verlorener Klagen die Spenden (1+2) übersteigen. Falls Du Dir vorstellen kannst, eine ähnlich hohe Spende unter Vorbehalt (2) zu tätigen, bitten wir Dich, von Option 3 abzusehen, weil das Sicherungsnetz für uns mit Unsicherheiten und Verwaltungsaufwendungen einhergeht.

Dear friends of H48,
The time has come! The first flat-share has received a contract cancellation and an action of eviction. Now we urgently need your help: so that so that H48 can remain our home, a social meeting place for our Schillerkiez, and a player in urban politics! Please spread this call.
With the ruling of the Federal Administrative Court of 9.11.21, which makes the exercise of the right of first refusal practically impossible in areas protected by the Milieuschutz (neighbourhood protection laws), our dream of self-administration has also been shattered. Our houses have been sold to a profit-oriented investor who doesn’t care about our home. So far it has mainly affected long-established businesses in our house. Soon it will be the turn of our shared flats, who have already been offered up on real estate portals. The flat-share residents have been systematically deprived of their housing rights on paper for decades. The owner assumes that these are commercial leases with partial residential use, which can be cancelled at any time at relatively short notice.
The first flat-sharing community received a notice of cancellation, the landlord wants to enforce by an action of eviction! This will only be the beginning. We will have to take legal action to obtain tenancy rights for our 8 flat-sharing communities and to avert the expected cancellations of our living space and the project room. These lawsuits are connected with financial risks that we have to bear in solidarity on as many shoulders as possible. We ask you to look into your wallet and see if you can make a contribution so that so that H48 can remain our home, a social meeting place for our Schillerkiez, a place for subcultures and alternative lifestyles, and last but not least a political organisation and an urban political actor. We are counting on you!

Your support options
1. The small but helpful donation (<200€)
You donate a sum of money of your choice up to 200€, which you transfer to the account of our house association (see above) with the reference „Spende“. Every euro counts! If funds are needed, this is the pot that will be used first. If your money is not needed, we will donate it to the Mietshäusersyndikat. No donation receipts can be issued.
2. The generous donation under reserve (>200€)
From an amount of 200€ upwards, your donation, which you can transfer to the account of our house association (see above) with the reference „Spende“, automatically falls under this category. If the small but helpful donations (1) are not sufficient, we will tap into this pot. If your money is not needed by the end of all court cases, we will transfer it back to you. If only a part of this pot is used, you will get your money back proportionally (example: if 40% of the pot is used up, you will get 60% of your donation back). No donation receipts can be issued.
3. The final safety net (>€1000)
With 1000€ or more you can also act as a guarantor. You contractually guarantee us an amount of your choice, which we will ask you to transfer quickly only in the case that the costs due to lost lawsuits exceed the donations (1+2). If you can imagine making a similarly large donation under reserve (2), we ask you to refrain from option 3, because the safety net for us involves uncertainty and administrative costs.
